Need of an Immigration Attorney

Like many others, you too must have asked yourself why you need an immigration attorney, when there is lot of information available online with USCIS assisting you in getting the latest immigration news, and your friends and family there to help you understand the process. One wishes things were that simple.

When it comes to immigration you need to understand your rights, get the latest immigration information, and make the right decision at the right time. You can get through these three steps, only with the help of an experienced immigration attorney.

Here is how an Immigration Attorney can help you with your Immigration Case:

US Visa Types

Family Visas

The US Family visa category is for the US citizens who want to sponsor their close family members for a temporary non-immigrant visa, or a permanent residency, commonly known as Green Card. The process for different types of Family Visas is different, and has its individual rules and requirements.

Employment Visas

The US Immigration system has a variety of employment visas. Every fiscal year, which starts from October 1st, and ends on September 30th, there are 140,000 employment-based immigrant visas are made available for qualified applicants. These employment based visas are divided into five (5) preference categories. Under some employment visa types, spouses and children can also accompany or follow-to-join the employment visa holders.

Business Visas

The business visa is for the foreign nationals who want to come to United States for Business Purposes. This visa type is normally referred to as B1, and is a temporary visa with specific rules and regulations.

Do you have a loved one who is getting deported from the United States?

When you have a loved one who is detained by ICE or is in a deportation proceeding, not too many people can give you a detail guide as to the process and what it takes to help your loved one. The best way to fight removal proceedings is to have some sort of relief available for your loved one. Call us (1-866-789-1664, 972-789-1664) and we will discuss this entire process with you and answer your specific questions.

What is ICE or Immigration and Custom Enforcement?

US Immigration and Customs Enforcement (ICE) as a part of DHS, the law enforcement functions of the US Customs Service, which include investigative and intelligence resources, the Immigration and Naturalization Service, the Federal Protective Service and the Federal Air Marshals Service, were merged into one organization. ICE is the primary investigative branch responsible for identifying and eliminating vulnerabilities in the nation’s border, economic, transportation and infrastructure security. ICE also has authority over illegal immigrant detention and removal.

Immigration Detention

When a foreign national is charged with a violation of the immigration laws, Department of Homeland Security serves the foreign national with a Notice To Appear. A Notice To Appear is an order requiring the foreign national to appear before an immigration judge; additionally, a Notice To Appear advises the foreign national of the nature of the proceedings, the alleged immigration law violations, and the consequence of failing to appear.

Generally, immigration court proceedings involve an initial “master calendar” hearing and, subsequently, an “individual” hearing. During the master calendar hearing, the immigration judge ensures that the foreign national understands the immigration violation charges, and during this hearing, the merits of the case and available relief are discussed before the immigration judge. If you or a loved is in this situation, you need to have an experienced immigration attorney with you to handle your immigration detention case.

Criminal Offense

If you have a criminal background, you should always have a certified copy of your criminal history, and have the phone number of an immigration attorney. Your attorney can let you know in advance that whether based on your criminal record, you can be bond eligible or not. At MAS Law Firm we have attorneys that handle both Criminal Defense Cases and Immigration Cases. If you have some prior criminal records, talk to our attorneys for their advice on both Immigration and Criminal Defense.

You do not have the right to a free attorney, but you have the right to hire your own lawyer, at no cost to the United States government. Also, you have the right to represent yourself.
